2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase our services.

If you are purchasing services on behalf of a business or organization, you represent that you have authority to enter into the agreement on that business's or organization's behalf.

3. Website Use

You may use vonwolfgraphics.com for lawful purposes and in accordance with these Terms.

You agree not to:

• Attempt to gain unauthorized access to our website, systems, accounts, or infrastructure

5. Graphic Design Subscriptions

vonWolf Graphics may offer recurring graphic design subscriptions.

Subscription services may include ongoing design requests, revisions, communication with a dedicated creative partner, and other features described on the applicable service page or plan.

Requests and Revisions

The number, type, and complexity of design requests that can be handled may depend on the plan, service capacity, project requirements, and the nature of the requested work.

"Unlimited" design requests or revisions, where advertised, does not mean that an unlimited number of projects can be completed simultaneously or instantaneously.

Requests are generally handled sequentially according to the applicable service process.

We may establish reasonable limits or prioritize requests when necessary to maintain service quality, manage capacity, prevent abuse, or comply with the applicable service terms.

Turnaround Times

Standard design requests are generally targeted for delivery within the timeframe stated on the applicable service page.

Turnaround times may vary depending on:

• Project complexity
• Number of revisions
• Customer feedback
• Required assets or information
• Third-party dependencies
• Customer response times
• Unusual or high-complexity requests

Estimated delivery times are not guarantees unless expressly stated otherwise in writing.

Customer Feedback

Customers are responsible for providing timely and reasonably clear feedback, information, files, brand assets, and approvals necessary to complete their projects.

Delays caused by missing information, delayed responses, or changes in project direction may extend delivery timelines.

6. Subscription Billing

Graphic design subscriptions are recurring services unless otherwise stated.

By purchasing a recurring subscription, you authorize the applicable payment provider to charge the payment method associated with your account according to the billing schedule presented at the time of purchase.

Current billing may be processed through Zoho Billing through vonWolf.co.

Subscription pricing, billing frequency, included services, and other plan terms will be presented before purchase.

You are responsible for maintaining accurate billing information and ensuring that your payment method remains valid.

7. Subscription Pauses and Cancellations

Where a subscription plan offers the ability to pause service, the applicable pause rules presented with that plan will apply.

Unless otherwise stated, pausing a subscription stops active service and future billing according to the applicable subscription terms. Access to previously completed work and other customer information may be retained in accordance with our retention practices.

Customers may cancel recurring services according to the cancellation process associated with their plan.

Cancellation does not automatically eliminate unpaid amounts or other obligations incurred before the effective cancellation date.

Unless a specific service agreement states otherwise, fees already paid for completed or commenced services are generally non-refundable.

8. Website Design and Management Services

vonWolf Graphics may provide website design and management services, including:

• Website design
• Website development
• Website content support
• Search engine optimization
• Website hosting
• Website maintenance
• Website updates
• Website edits
• Analytics setup
• Security and software updates
• Related website services

The exact services included in a website project will depend on the package, proposal, agreement, or service plan purchased.

Website Scope

A website project may include one or more pages, e-commerce functionality, integrations, forms, analytics, SEO elements, hosting, and other features.

New functionality, pages, integrations, or substantial changes outside the agreed scope may require additional fees.

Website Edits

Where a website plan includes ongoing edits, those edits apply to the existing website and features included in the applicable service.

New pages, major redesigns, new functionality, custom development, or other work outside the included service may be quoted separately.

9. Website Payment Options

Website services may be offered through different payment structures, including:

• Deposit plus monthly payments
• Monthly-only payments
• Other payment arrangements specifically agreed upon in writing

The payment structure, total project price, payment schedule, and included services will be provided before the project begins.

Failure to make required payments may result in suspension of services, restricted website access, suspension of hosting or management services, or termination of the applicable agreement, subject to the terms of that agreement.

10. Website Ownership and Transfer

Unless otherwise agreed in writing, vonWolf Graphics retains ownership of its proprietary tools, systems, processes, templates, reusable components, internal methods, and other materials that are not created specifically for the customer's project.

Customer-specific website content and other customer-owned materials remain the customer's property, subject to any applicable third-party rights.

For website services involving a payment period or financing arrangement, ownership and transfer terms may depend on the specific agreement.

Where a website service provides for transfer after the applicable payment period is completed, the customer may request transfer of the website according to the applicable service terms.

Transfer may require cooperation from the customer and may involve third-party hosting, domain, software, licensing, or account requirements.

11. Hosting

When hosting is included as part of a vonWolf Graphics website service, hosting is provided according to the applicable service agreement.

Hosting availability may depend on third-party infrastructure and service providers.

We may perform maintenance, updates, security work, or other actions reasonably necessary to operate and maintain hosted websites.

Hosting does not guarantee uninterrupted availability.

If hosting is transferred to the customer or another provider, the customer becomes responsible for the applicable hosting provider's fees, policies, security, backups, and service availability unless otherwise agreed.

12. Domains and Third-Party Accounts

Customers may provide vonWolf Graphics access to domains, hosting accounts, WordPress accounts, analytics platforms, DNS systems, or other third-party services.

We only access systems that the customer provides or authorizes us to access.

The customer remains responsible for maintaining ownership of accounts and ensuring that vonWolf Graphics has the appropriate authorization to perform requested work.

Third-party services are governed by their own terms and policies.

vonWolf Graphics does not guarantee the availability, performance, pricing, policies, or functionality of third-party services.

13. Customer Responsibilities

Customers are responsible for providing accurate and complete information necessary to perform services.

This may include:

• Business information
• Brand assets
• Logos
• Images
• Written content
• Product information
• Pricing information
• Login credentials
• Domain information
• Hosting information
• Website content
• Legal notices and policies
• Customer-provided instructions
• Required approvals

Customers are responsible for ensuring that they have the right to use materials they provide to vonWolf Graphics.

Customers are also responsible for reviewing and approving completed work before publication or use.

14. Customer Content and Materials

You retain ownership of materials that you provide to vonWolf Graphics unless otherwise agreed.

By providing content, images, logos, trademarks, text, files, or other materials to us, you grant vonWolf Graphics the permission necessary to use, reproduce, modify, store, and display those materials solely for the purpose of providing the services you have requested.

You represent that you have the necessary rights and permissions to provide those materials and authorize us to use them for the requested services.

You are responsible for claims arising from materials that you provide when those claims result from your lack of rights or authorization.

15. Intellectual Property

Unless otherwise agreed in writing, vonWolf Graphics retains ownership of its original proprietary processes, systems, internal templates, tools, methods, frameworks, and reusable resources.

Upon full payment for a project, the customer generally receives the rights to use the final approved creative work produced specifically for that customer according to the scope of the applicable service agreement.

Source files may be provided when included in the applicable service or agreement.

Third-party fonts, stock photography, plugins, software, graphics, applications, and other licensed materials remain subject to their respective licenses.

The customer is responsible for complying with applicable third-party licensing requirements after delivery or transfer.

16. Portfolio and Promotional Use

Unless otherwise agreed in writing, vonWolf Graphics may display completed work created for customers in its portfolio, website, social media, presentations, case studies, marketing materials, and other promotional materials.

We may identify the customer's business when doing so is reasonably appropriate.

If a project contains confidential information or the customer has a written agreement restricting promotional use, those restrictions will control.

17. Artificial Intelligence and Third-Party Tools

vonWolf Graphics may use software, technology, automation, artificial intelligence tools, stock libraries, plugins, hosting platforms, analytics services, and other third-party tools as part of its internal workflow or service delivery.

The use of a particular tool may vary depending on the project.

Where third-party tools are used, their applicable terms, licenses, and privacy policies may also apply.

vonWolf Graphics remains responsible for the services it agrees to provide, but cannot guarantee the continued availability, functionality, pricing, or policies of third-party tools.

18. Design Approvals and Revisions

Customers are responsible for reviewing work and providing feedback or approval.

Once a design, website, or other deliverable has been approved, subsequent changes resulting from a change in direction may be treated as a new request or additional work depending on the applicable service.

Customers should carefully review spelling, pricing, contact information, legal statements, product information, and other business-specific information before approving final work.

vonWolf Graphics is not responsible for errors in customer-provided information that are approved or published by the customer.

19. Third-Party Content and Services

Projects may incorporate third-party services, software, fonts, stock photography, plugins, APIs, hosting services, payment providers, analytics platforms, or other technology.

vonWolf Graphics does not control third-party services and cannot guarantee that they will remain available, compatible, secure, or unchanged.

Additional third-party fees may apply where required.

20. Search Engine Optimization and Marketing

When SEO or related marketing services are included, vonWolf Graphics may implement reasonable optimization practices based on the agreed scope.

SEO and marketing services do not guarantee:

• Specific search engine rankings
• A specific number of visitors
• A specific number of leads
• A specific number of sales
• Advertising performance
• Search engine indexing
• Search engine algorithm behavior

Search engines and advertising platforms independently determine rankings, distribution, eligibility, and performance.

 21. Website Performance and Availability

We work to provide reliable website services, but we do not guarantee that a website will always be available, error-free, secure, or compatible with every device, browser, plugin, software version, or third-party service.

Website interruptions may result from:

• Hosting outages
• Domain issues
• DNS problems
• Software failures
• Plugin conflicts
• Security incidents
• Third-party service interruptions
• Internet infrastructure
• Maintenance
• Events outside our reasonable control

We will make reasonable efforts to address issues within the scope of our services.

22. No Guarantee of Business Results

vonWolf Graphics provides creative and website services intended to support business growth, visibility, professionalism, consistency, and marketing efforts.

However, we do not guarantee a particular business result.

We do not guarantee that our services will result in:

• Increased revenue
• Increased customers
• Increased leads
• Increased website traffic
• Increased conversion rates
• Specific advertising results
• Specific search rankings
• Business growth
• A specific return on investment

Business results depend on many factors outside our control.

23. Fees and Additional Work

Services outside the agreed scope may require additional fees.

Before performing significant out-of-scope work, we may provide an estimate, proposal, or other notice describing the additional work and applicable charges.

Failure to approve additional work does not create an obligation for vonWolf Graphics to perform that work.

 24. Refunds

Unless otherwise stated in a specific service agreement or required by applicable law, payments for services that have already been performed, work already initiated, subscriptions already provided, or non-refundable third-party costs are not automatically refundable.

Any applicable refund rights will be determined by the specific service agreement, purchase terms, or applicable law.

 25. Suspension and Termination

vonWolf Graphics may suspend or terminate services when reasonably necessary, including when:

• Payment is overdue
• A customer materially violates these Terms
• A customer engages in abusive, threatening, fraudulent, or unlawful conduct
• Continued service would create a security or legal risk
• A customer provides unauthorized or unlawful materials
• A customer attempts to misuse our systems or services

If services are terminated because of a customer violation, outstanding amounts may remain due.

Customers may terminate services according to the applicable service or subscription terms.

26. Confidentiality

We understand that customers may provide confidential business information while working with vonWolf Graphics.

We will use reasonable measures to protect confidential information and will not intentionally disclose confidential information to unrelated third parties except when:

• Necessary to provide the requested services
• Authorized by the customer
• Required by law
• Necessary to protect our rights, systems, customers, or business
• The information is already publicly available
• The information was independently developed or lawfully obtained from another source

Specific confidentiality requirements may be established through a separate agreement when appropriate.

 27. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless vonWolf Graphics and its owners, contractors, service providers, and representatives from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your violation of these Terms
• Your misuse of our services
• Materials or information you provide without the necessary rights or permissions
• Your violation of applicable law
• Your violation of another person's rights

28. Limitation of Liability

To the maximum extent permitted by applicable law, vonWolf Graphics will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of our website or services.

• Goodwill
• Business interruption

To the maximum extent permitted by applicable law, the total liability of vonWolf Graphics arising from a service or agreement will not exceed the amount you paid to vonWolf Graphics for the specific service giving rise to the claim during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited under applicable law.

29. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the website and services are provided on an "as available" and "as provided" basis.

vonWolf Graphics does not guarantee that:

• The website will always be available
• The website will be completely error-free
• Services will always be uninterrupted
• Third-party services will remain available
• Services will produce a particular business outcome
• Website content will achieve a particular search ranking or marketing result

Specific written warranties, if any, will be limited to those expressly provided in the applicable service agreement.

30. Force Majeure

vonWolf Graphics will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

• Hosting outages

• Government actions
• Labor disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Your continued use of the website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes to an existing customer agreement may be governed by the terms of that agreement rather than these general website Terms.

These Terms, together with any applicable service agreement, proposal, order, subscription terms, or other written agreement between you and vonWolf Graphics, constitute the agreement governing your use of the applicable services.

If there is a conflict between these general Terms and a specific written agreement, the specific written agreement will control for that service or project.
